Reflexiones en espera de un fallo del nuevo tribunal constitucional: El pretendido ajuste a la constitución de los artículos 95 números 6° 7° y 8° en relación con el artículo 96 inciso 3° del código de minería

The author intends to prove that the extinction of a mining concession based on article 96.3 of Chilean Mining Code is not according to the so called principle of "Supremacy of the Constitution" especially if the current legislation that establishes a hierarchy of norms, as well as the Constitutional Tribunal's decision of 1983 in the matter, is taken into account. The author also shows the eventual effects of considering article 93.6 as Constitutional.
