Abstract

The present investigation explains which is the current older person’s protectional status, from an international perspective, through international Human Rights instruments, to what we understand in our country as an older person protectional normative framework. In this scenario the Inter-American convention on protecting the Human Rights of older persons has marked a before and after, establishing itself as the first compulsory international instrument in this subject, which is of special relevance today. We managed to compare the situation in some countries of the region in relation to Chile is, establishing as an answer that our country is starting to reach the new standard that demands subscribing to this instrument. In turn, proposals are delivered regarding solutions to actual difficulties that afflict older persons, inspired by the principles that the Convention recognizes and positions as fundamental.
