Abstract
This paper analyzes the principle of non-contradiction, according to the necessity defense, in reference to the plank of Carneades case. In this case, two shipwrecked see a plank that can only support one of them, and both struggle for it. This work tries to prove that the subsistence of these two actions is possible, without damaging the right or wrong criminal dogmatic duality, in the defense of necessity.
