Orígenes de la defensa judicial del fisco en chile: Antecedentes Histórico-jurídicos previos a la creación del consejo de defensa del estado en 1933

This work analyzes the main historical and legal antecedents that allowed laying the foundations for the creation of the State Defense Council, as an autonomous and independent body that today is in charge of defending the patrimonial interests of the Treasury. The most relevant events that marked the genesis of this Council are based –mainly– on the nitrate economic crisis that began at the end of the 19th century, the permanent confusion to determine which body was to assume the judicial defense of the State, and also the latter was at a disadvantage in the face of the increasing judicialization of lawsuits against individuals, who hired politicians and influential lawyers of the time as opposed to the precariousness of the fiscal judicial service.
