Abstract

For some authors, the only agent of unconstitutional omission would be the legislator due to the immediate link between this and that. However, in this work we will demonstrate that against such a position, at least in Chile, jurisprudentially, it is also admitted that the Administration is an agent of unconstitutional omission due to its ability to directly violate fundamental rights.
