Abstract
Part of the legal literature and jurisprudence have indicated that the Vienna Convention on the International Sale of Goods contains a general right of retention based on the interpretation of several provisions of the Convention, including Article 58 and Article 71. This work analyzes these articles to determine if they are cases of the right of retention, or rather they establish cases of exceptio non adimpleti contractus in its various modalities.
