Abstract
This paper questions the judicial practice wich subsume the criminal complaint of a nonexistent crime in article 269 bis of the Chilean Criminal Code. Two problems are identified about the interpretation of the verb «provide» and the legal requirement «criminal offence», and the study concludes the non-criminality of the act respect the obstruction of criminal investigation.
