Abstract
Proliferation of especial procedures poses several practical difficulties to the observance of the formal requirement related to adequate judicial procedure. This is often the case when the litigation involves indigenous people. This situation triggers procedural issues and nullity, which alter procedural rules and, sometimes, the application of substantive law.
