Abstract
This article proposes to examine the current discussion about the constitutional decision as the last word and the authority promoted by Ronald Dworkin and Jeremy Waldron. For that, the debate is centered on the control of constitutionality, beginning with Waldron's criticism of Dworkin's theory of correct response, the concept of democracy and its relation to the rule of the majority, and ending with the relationship between the thought of the two jurists on the authority of the legislator.
