Abstract
The present article critically analyzes the applicability of the cause of nullity contemplated in article 478 letter b) of the Labor Code against the tutela judgments issued by judges of instance in relation to demands in labor protection proceedings for labor harassment. Specifically, it attempts to elucidate which issues, in a labor tutelage trial for harassment, are factual aspects that require the judge to strictly apply the rules of sound criticism and which issues constitute, rather, matters of legal qualification, susceptible to be reviewed by means of nullity, invoking the cause of letter c) of article 478, instead of letter b). This will be achieved by paying particular attention to the new definition of labor harassment incorporated by Law No. 21,643 to the new letter b) of article 2, and the new article 211-E of the labor statute, which orders the investigator to evaluate the seriousness of the harassing conduct before applying a sanction.
