This paper analyzes the problem of employee poaching by a company that is their employer's competitor. We study the situation faced by these employees, both from a labor as well as from a competition standpoint. Moreover, we analyze the cases of employees who intervene in favor of one of their employer's competitor, to facilitate the hiring of their coworkers. In order to carry out the research herein, we discuss each of the poaching hypotheses set forth in article 14 of the Spanish Unfair Competition Act.
